CONTRACT
The terms of this Contract have been agreed upon and accepted by both
Buyer(s) and Breeder by their signatures at the end of this Contract.

Section 2. Puppy Pick-Up:
- Buyer
agrees to meet with the Breeder, Sherri Brett of Brett’s Painted Bostons,
face-to-face to pick-up the puppy at the Breeder’s home, airport, or other
agreed upon location. Buyer must notify
the Breeder in advance if a friend or relative of the Buyer will be picking up
the puppy on behalf of the Buyer.
- Puppy
will be available for pick-up at eight (8) weeks of age. Buyer must be able to take possession of the
puppy when it is old enough to leave or other charges will apply before it will
be released. If no prior arrangements or
contacts have been made when the puppy is ready to leave, but not
taken/accepted, the puppy could go up for resale to someone else and all monies
paid to the Breeder will be forfeited. The Breeder will make every effort to work with your schedule (and with
hers) to make the transition a happy experience. Please know that your puppy has been
well-loved by the Breeder and her family from its birth until when you take
him/her home.
- If
Buyer is too far away to pick-up the puppy at the Breeder’s home, Breeder will:
(1) meet you at her airport for a travel fee (preferred), or (2) fly with the
puppy, in cabin, to meet you at your closest airport. Please note, option (2) will include a travel
fee and airline ticket costs for Breeder and puppy. The Breeder’s closest airport is Indianapolis,

Section 3. Puppy Deposit and Payments:
- All
puppy deposits are nonrefundable. Puppy
deposits must be made via personal check or bank check made payable to Sherri
Brett.
- A
second - final payment will be paid when the
puppy is picked up. This final payment
must be made in cash only, large bills. The Breeder will advise you of the amount.
- A
check to cover AKC registration costs/microchip registration will need to be brought with you to
pick-up the puppy as well. If the puppy
is going to be registered in one owner’s name, the cost is $39.99 + $17 for registering the microchip ($56.99). If the puppy is going to be registered in two
owners’ names (this applies to married couples), the cost is $49.99 + $17 to register the microchip ($66.99). Please make the check payable to AKC. Breeder will file the registration with AKC.

- If
the Breeder is driving to meet you at a different location (other than locally), a travel fee will
be due upon pick-up as well.
- Any
and all veterinarian fees after leaving the Breeder will be the sole
responsibility of the Buyer(s). The Breeder will not be responsible for any
medical expenses incurred after the puppy goes home with the Buyer(s).
Section 4. Health Guarantee:
- All
puppies from the Breeder are guaranteed for one year from their dates of birth,
against fatal and life threatening, congenital disease. This includes severe hip dysplasia which
hampers the movement of the dog and requires surgery to correct (unless caused
by an injury), kidney, heart, pancreas, spine, and liver problems of a severe
life-threatening or altering nature. If
the puppy dies within this one-year time frame, the Buyer must pay to have it
autopsied to determine the reason for its death. If the puppy’s death was congenital in
nature, the Breeder will replace the puppy.
- This
Health Guarantee will be VOIDED if the puppy is bred.
- The
Health Guarantee will be VOIDED if the Buyer neglects to follow through
with all of the required puppy vaccinations, de-worming schedule, etc. from a
licensed veterinarian.
- The Health
Guarantee will be VOIDED if the Buyer fails to purchase and have the
NUVET VITAMIN present for puppy pick-up. To order the NUVET VITAMIN please call
1-800-474-7044, with code #18761. Breeder will receive a confirmation email
once Buyer purchases the vitamin. (Tablets are hard, you'll need to leave some out to soften)
- The
Health Guarantee will be VOIDED if Buyer does not have the puppy examined by
a licensed veterinarian within seventy-two (72) hours after delivery. Breeder must be immediately informed of the
examination results by email (paintedlady1990@yahoo.com).
- Replacement
of a puppy under the Health Guarantee will be as follows:
- Puppy must show the defect by one year of age;
- Breeder must be notified of the problem within
two business days of the licensed veterinarian’s determination and have two
reports from two un-associated veterinarians stating the same problem;
- Breeder will provide a replacement puppy of
equivalent value;
- Buyer may elect to keep the puppy and this Contract
will no longer apply;
- No refund, in full or in part, will be given;
- A returned puppy must be returned to the Breeder
in good condition, other than the specified problem, at the expense of the
Buyer and with all original paperwork. The buyer will then qualify for a replacement puppy;
- Buyer is responsible for travel costs to and
from the Breeder under this Health Guarantee;
- The Health Guarantee applies to the original
Buyer only and is non-transferable;
- No replacement puppy will be given if the puppy
has been euthanized without permission from the Breeder after a consulting with
the treating veterinarian;
- A replacement puppy will be of comparable
quality and same sex based upon availability;
- A replacement puppy may or may not be from the
same parents of the original puppy;
- There are certain disorders that may be caused
by environmental factors including, but not limited to: allergies, thyroid
dysfunction, demodectic mange, and other autoimmune disorders (sometimes caused
by vaccinations) that are not covered by the Health Guarantee;
- The Breeder does not guarantee against
conditions that may or may not be stress related from the move to a new
home. These stress related conditions
that have previously remained dormant can be triggered by the above unfortunately
cannot be diagnosed until an active case becomes evident. Some of these stress related conditions or
illnesses are: coccidia, giardia, hypoglycemia (low blood sugar), kennel cough,
and any parasites/worms/mites that the puppy may have acquired after leaving
the Breeder; and
- Any physical problem which is or could be the
result of injury from being overweight or underweight, or being over exercised,
is not covered under the Health Guarantee.
- The
Breeder has the right to ask you for your veterinarian records if needed for
the one-year Health Guarantee. The Health
Guarantee does not cover what in the bulldog breed is considered normal,
including, but not limited to: cherry eye, entropion, luxating
patella, teeth misalignment that does not hinder the normal eating/drinking
function, skin allergies, elongated soft palate, and stenotic nares (pinched
nostrils). The Health Guarantee does not
cover illness resulting from improper feeding/de-worming or care after leaving
the Breeder. All items covered under the
Health Guarantee are by replacement only. The Breeder does not give refunds.
- When
the puppy is picked up, the puppy will have received a veterinarian health
check, proper vaccinations, and de-worming. The Buyer(s) will be informed of what veterinarian care the puppy has
already received and what future vaccinations and de-worming are due.
- The Health Guarantee does not include Coccidia
and Kennel Cough which is possible in puppies moved to new surroundings and
usually caused by bacteria. Kennel Cough
is self-limiting and like the common cold, it must run its course. Full recovery is expected and Kennel Cough on
its own is not life threatening.
- Breeder is only guaranteeing the puppy under
this Contract as a healthy companion/pet, whether he/she can reproduce to carry
on the bloodlines cannot be determined as a puppy and that the puppy’s pedigree
is correct to the best of the Breeder’s and Veterinarian’s knowledge. Adult size, weight, and the ability to
reproduce cannot be guaranteed.
- In the case, the puppy is a Show Prospect, the Breeder does not guarantee the puppy will win
in the ring as no one can tell how the puppy will look when he/she is
older. All show/breeding puppies will
be co-owned with the Breeder.
Section 5. Buyer(s) Responsibilities:
Buyer must provide the puppy with routine preventative care,
such as, but not limited to:
- Annual physical examinations by a licensed
veterinarian;
- Follow veterinarian guidelines for vaccinations,
flea/tick/heartworm, and de-worming; and
- Refraining from taking the puppy to public
places around other pets until all vaccinations are given so the puppy will be
fully immunized against any contagious diseases.
Section 6. Puppy
Limitations:
- Do
not allow your puppy to use stairs until he/she is at least one year of age.
- Keep
your puppy off unknown surfaces until the puppy is at least 16 weeks old and
has had all his/her puppy shots to prevent contracting diseases such as Parvo,
Distemper, and other communicable diseases.
Section 7. Welcome Home
Policy:
- If
at any time during the life of the puppy/dog purchased under this Contract,
Buyer is unable to be keep the puppy/dog, the Breeder must be notified and will
accept the puppy/dog back to find it a suitable home. You cannot re-home or sell the
puppy/dog. There is always a Welcome
Home Policy on ALL of our puppies/dogs. No return of money or replacement puppy is offered in this circumstance.

Section 8. Applicable Law and Forum:
Buyer understands that this
Contract is governed under the laws of the State of Indiana, County of
Martin. Any legal issues arising under
the terms are this Contract will be adjudicated in the State of Indiana, County
of Martin, regardless of where the Buyer lives, even if out of state.
This Contract supersedes any and all previous agreements. This Contract is null and void if the terms
listed above, are not fulfilled.
By signing this Contract, I am acknowledging that I have fully read,
